Terms of Service

1. Acceptance

By creating an account or using Kwincast ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Kwincast is a free, social sports prediction platform. Users create private groups, invite friends, and compete by predicting match scorelines across official tournaments and custom brackets. The Service is currently in early-access (MVP) phase.

No real money or prizes are involved. Kwincast is a prediction game for entertainment purposes only. Points and standings have no monetary value.

3. Eligibility

You must be at least 13 years old to use Kwincast. By using the Service you represent that you meet this age requirement. Users in jurisdictions that require a higher minimum age (e.g., 16 in certain EU member states) must meet the applicable local requirement.

4. Accounts

You sign in via Google OAuth through our authentication provider, Clerk. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at support@kwincast.app if you believe your account has been compromised.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service, its servers, or its databases.
• Interfere with or disrupt the integrity or performance of the Service.
• Create accounts by automated means or under false pretenses.
• Harass, abuse, or harm other users through the platform.

6. User Content

You retain ownership of any content you submit (e.g., group names, custom tournament titles). By submitting content you grant us a limited, non-exclusive license to store and display it within the Service for operational purposes. We do not claim ownership of your content.

7. Intellectual Property

All software, design, and branding elements of Kwincast are owned by or licensed to us. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary materials without prior written permission.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. Sports data is sourced from third parties and may be delayed or inaccurate.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Kwincast and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if required for operational or legal reasons.

When you delete your account (via the in-app account menu or by emailing us), we anonymize your profile and remove your predictions and group memberships. Content you created that other members rely on (such as groups or competitions) may remain with your identity shown as "Deleted user".

You may also request account deletion by emailing support@kwincast.app.

11. Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of the Service after a change constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, United Kingdom, without regard to conflict-of-law rules. Nothing in these Terms limits rights that cannot be waived under the laws of your country or region of residence.

13. Service Availability

We make the Service available on the web to users worldwide, but we do not represent that it is appropriate or legal in every jurisdiction. You are responsible for complying with local laws when using Kwincast.
